PELESTARIAN RUMAH TANGGA PERSPEKTIF MAQADIS AL-SYARI’AH DALAM HUKUM KELUARGA ISLAM

Abstract

This article discusses household preservation from the perspective of Maqasid al-Syari'ah as a normative basis in Islamic family law. Using a normative qualitative approach and literature study, this research examines how the principles of Maqasid al-Syari'ah, such as safeguarding religion (ḥifẓ al-dīn), soul (ḥifẓ al-nafs), reason (ḥifẓ al-'aql), lineage (ḥifẓ al-nasl), and property (ḥifẓ al-māl) are applied in an effort to maintain the integrity of the house ladder. The results of the study show that household preservation in Islamic law does not only emphasize legal-formal aspects, but more on fulfilling the values ​​of benefit and preventing mafsadat, both by married couples and by the state through regulations and religious institutions.
