PERNIKAHAN BEDA AGAMA: PERSPEKTIF HUKUM, SOSIAL, DAN BUDAYA DI INDONESIA

This study examines the phenomenon of interfaith marriage in Indonesia from legal, social, and cultural perspectives. In a pluralistic society, interfaith marriage is a complex issue due to the clash between religious norms, state law, and societal values. Law Number 1 of 1974 on Marriage serves as the main legal foundation, but its provisions do not explicitly accommodate interreligious marriage practices. This research employs a descriptive qualitative approach, utilizing in-depth interviews, participatory observation, and document analysis. The findings reveal inconsistencies in legal implementation, strong social resistance, and significant cultural challenges. Therefore, legal reform and an interdisciplinary approach that considers Indonesia's multicultural context are necessary to ensure justice and the protection of human rights for all citizens.
