LEGAL REFORM IN INDONESIA IN TREADING THE REVOLUTION

Abstract

Hukum merupakan hal yang penting dalam kehidupan masyarakat, Hukum sejatinya akan berkembang dengan perkembangan masyarakat itu sendiri. Proses perkembangan masyarakat yang begitu cepat dan sangat kompleks juga semakin meyakinkan bahwa peran hukum di dalamnya sangat penting, Roscoe Pound menyampaikan bahwa “Law is the tool of social engineering†(hukum sebagai sarana dalam perubahan masyarakat). Sejalan dengan adanya Revolusi industri 4.0. yang memang dimotori oleh negara-negara barat dengan kekuatan teknologi, industri, dan pasar bebasnya, salah satu negara di Asia yakni Jepang tak kalah juga untuk menawarkan sebuah gagasan bernama “Society 5.0â€. Hal ini berdampak terhadap perkembangan budaya hukum masyarakat di Indonesia.

Tujuan penelitian ini adalah untuk mengetahui Pembaharuan Hukum di Indonesia dalam Menapaki Revolusi Society 5.0. metode penelitian pada penulisan ini adalah yoridis normatif, sehingga yang menjadi kesimpulan pada penelitian ini adalah Gagasan society 5.0 merupakan gagasan yang berdampak terhadap perkembangan hukum di masyarakat khususnya terhadap budaya hukum di masyarakat. Perkembangan zaman yang begitu pesat membuat membuat hukum lari terbirit-birit mengejarnya Di era 4.0 hukum belum dapat menyesuaikan dengan perkembangannya saat ini perubahan 5.0 mempengaruhi perkembangan hukum di masyarakat.

Hukum informasi dan transaksi elektronik sebenarnya telah menjawab perubahan ataupun pergeseran revolusi industri 4.0 namun tidak begitu dapat menyesuaikan dengan kondisi hukum yang ada di masyarakat gagasan society 5.0 menjadi menjadi tanda perubahan hukum yang tidak terukur arahnya tentu budaya hukum di masyarakat menjadi kunci terhadap pergeseran revolusi industri 4.0 ke revolusi society 5.0. Tingkat teknologi yang berkembang pesat justru berbanding lurus dengan tingkat kejahatannya bisa kita lihat dengan adanya cybercrime dan tindak pidana lainnya yang diatur dengan undang-undang ITE.

In line with the industrial revolution 4.0. which is indeed driven by western countries with their technological, industrial and free market strengths, one of the countries in Asia, namely Japan, has also offered an idea called "Society 5.0". This has an impact on the development of the legal culture of society in Indonesia.

The purpose of this study was to determine the legal reforms in Indonesia in treading the Revolution Society 5.0. the research method at this writing is normative yoridis, so that the conclusion in this study is the idea of ​​society 5.0 is an idea that has an impact on the development of law in society, especially on legal culture in society. The rapid development of the times has made the law run wildly after it. In the 4.0 era the law has not been able to adapt to its current development, the 5.0 change affects the development of law in society.

The law of information and electronic transactions has actually answered the changes or shifts of the industrial revolution 4.0 but not so able to adapt to the legal conditions that exist in society. to revolution society 5.0. The level of technology that is developing rapidly is directly proportional to the level of crime, we can see it with the existence of cybercrime and other criminal acts regulated by the ITE law.
